FDBR requirements

Florida's law, effective July 1, 2024, applies only to very large companies: more than $1 billion in global revenue plus one of three conditions, such as deriving half of revenue from online advertising or operating a smart speaker and voice service. Within that scope it includes opt-outs of targeted advertising and sale, opt-in consent for sensitive data, limits on collecting precise geolocation, and protections for known children, and it imposes separate obligations on online platforms that sell data about minors. The Department of Legal Affairs enforces, with a discretionary 45-day cure period and penalties of up to $50,000 per violation, tripled for violations involving known children.
